2008 Brazos de Dios H.O.G. Foundation/Independence Harley-Davidson Raffle Fundraiser Official Rules
1. To be eligible, the winner must be at least 18 years of age at the time of entry, and a legal resident of the United States of America.
2. The winner will take ownership of a 2008 Harley-Davidson Crimson Red Deluxe FXCWC "Rocker C" Motorcycle (henceforth, referred to as "The Prize"). The winner is responsible for delivery of The Prize.
3. Winner need not be present to win.
4. Winner shall be responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with the prize. The IRS requires that income tax withholding on prize values of $5,100 or greater must be paid upon award and distribution. Government rules governing withholding can change without notice. The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution. Check with your qualified financial advisor for additional information.
5. Independence Harley-Davidson/Buell, Directors, Officers of the Brazos de Dios H.O.G. Foundation, and Brazos de Dios H.O.G chapter, Sponsors of the raffle/fundraiser, reserve the right to conduct a background check on any potential contestant and reserve the right in their sole discretion to disqualify any person based on such background check if it is determined that the contestant's involvement might reflect negatively on the Sponsors.
6. Raffle starts on June 20, 2008, and tickets will be sold through November 22, 2008, or until all tickets have been sold, whichever occurs first.
7. One (1) winner will be drawn at random on November 22, 2008 at Independence Harley-Davidson/Buell in College Station, TX.
8. Tickets are $20.00 each, and a total of 2,500 tickets will be sold.
9. The Prize must be claimed within 30 days of notification. Should The Prize not be claimed within the 30 days, it will then be forfeited to Brazos de Dios H.O.G Foundation.
10. Upon issuance of a raffle ticket, all sales are final and non-refundable.
11. Independence Harley-Davidson/Buell, Brazos de Dios H.O.G Foundation assumes no responsibility for lost, late, misdirected, mutilated, incomplete, illegible, or non-delivered entries. Any mutilated, incomplete, or illegible entries will be deemed invalid, and shall be immediately disqualified.
12. Any unsold tickets become the property of Brazos de Dios H.O.G Foundation.
13. Proceeds from this raffle will benefit the Brazos de Dios H.O.G Foundation Toy Run, and/or other charitable efforts.
14. A Driver's license, or some other acceptable form of identification, must be presented when claiming The Prize.
15. Participants (and the winner, by accepting The Prize) release Independence Harley-Davidson/Buell, Brazos de Dios H.O.G Foundation, and Brazos de Dios H.O.G, and each of their respective directors, officers, partners, employees, and agents, including advertising and promotion agencies, from any and all liability with respect to participation in the raffle and possession or use of The Prize, and also acknowledge that they did not receive any representations, warranties, and/or guarantees, expressed or implied, in fact or in law, relative to The Prize, including but not limited to, its quality, mechanical condition, or fitness. In the case of any dispute, the decision of Independence Harley-Davidson/Buell and/or Brazos de Dios H.O.G Foundation shall be final.
16. Void where prohibited.
17. Winner releases their right for use of their image and audio for promotional use to the Sponsors.
